1. Acceptance of Terms

By accessing or using any website, mobile site, or online service owned or operated by Chouteau County Fairgrounds (collectively, the “Site”), you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree, do not use the Site.

  • “CCF,” “we,” “us,” or “our” refers to Chouteau County Fairgrounds and its governing Fair Board.

  • “User,” “you,” or “your” refers to anyone who accesses or uses the Site.

By completing a purchase, you authorize the processor to charge your designated payment method for the total amount shown, including applicable taxes and fees.

All prices are listed in U.S. dollars and are subject to change without notice. CCF reserves the right to cancel or refuse any order at its sole discretion.

7.3 Refund Policy

Unless stated otherwise for a specific Product, all sales are final and non‑refundable except where required by law or if an event is canceled in its entirety.

8. Third‑Party Links & Services

The Site may contain links to third‑party websites or services (“Third‑Party Sites”). We are not responsible for the content, policies, or practices of Third‑Party Sites. Linking to or integrating with Third‑Party Sites does not imply endorsement.

9. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON‑INFRINGEMENT. CCF DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR‑FREE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CCF AND ITS OFFICIALS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CCF’S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CCF IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR (B) $100.

11. Indemnification

You agree to defend, indemnify, and hold harmless CCF and its officials, employees, volunteers, contractors, and affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Site; (b) your violation of these Terms; or (c) your infringement of any intellectual‑property or other right of any person or entity.

12. Privacy

Our collection and use of personal information are governed by the CCF Privacy Policy. By using the Site, you consent to the processing of your data in accordance with that policy.

13. Accessibility

CCF strives to make the Site accessible to all users. If you experience difficulty accessing any Content, please contact us so we can accommodate your needs.

14. Suspension & Termination

We may suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to CCF or other users.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Montana, without regard to conflict‑of‑law principles. Any dispute shall be resolved exclusively in the state courts located in Chouteau County, Montana.

16. Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be stricken and the remaining provisions will remain in full force.

17. Entire Agreement

These Terms constitute the entire agreement between you and CCF regarding the Site and supersede all prior or contemporaneous communications.
